When Supreme Court Justice Antonin Scalia passed away earlier this year, it sparked a firestorm of debate from both parties. President Obama, Democratic nominee Hillary Clinton and practically all democrats saw Scalia’s death as an opportunity for Obama to appoint a liberal justice to further his liberal agenda.
But Republicans in Congress refused to hold a vote on Obama’s nominee, asserting instead that the next president should be the one to nominate Scalia’s replacement.
During the campaign, President-elect Donald Trump released a list of potential nominees that he would select from to fill the Supreme Court vacancy should he win the election. Now that he has won, speculation is again running rampant about who he will nominate.
Fox News has speculated that an additional name might have been added to the list, that of former rival Sen. Ted Cruz, R-Texas.
Cruz’s name has been floated as a potential nominee for weeks despite the at times hostile interactions between he and Trump during the contentious Republican primary. Fox’s “Outnumbered” panel debated the possibility of a Cruz nomination on Monday.
“I think that Senator Ted Cruz could actually be a good choice from a political standpoint because Senator Cruz has already tipped his hat to the fact that he may be a nuisance of sorts to President-elect Donal Trump, so this is one way of someone who is strictly going to adhere to the Constitution, have those conservative values and sort of get him out of the way politically,” Fox News contributor Lisa Boothe said.
Perhaps the biggest barrier to such an appointment is the hostility the two men demonstrate toward one another during the election. The mudslinging was rampant. Trump nicknamed Cruz “lying Ted” and criticized Cruz’s wife. Cruz attacked Trump relentlessly and questioned his ability to lead the country. At the Republican National Convention in July, Cruz addressed the crowd but stopped short of endorsing Trump.
Trump is expected to announce his nominee soon after his January inauguration.
